Privacy Policy

SCENE IN THE DARK (“we,” “us,” or “our”) is a concert photography brand operated by Michael Caswell, a sole proprietor based in Vancouver, British Columbia, Canada. This Privacy Policy explains what personal information we collect when you visit sceneinthedark.com (the “Site”), why we collect it, how we use and share it, and the choices you have about your information.

By using the Site or purchasing a print, you agree to the practices described in this Policy. If you do not agree, please do not use the Site.

1. Information we collect

We collect personal information in three ways:

a) Information you give us directly

  • Order information when you purchase a print: your name, shipping address, email address, and phone number.
  • Communications when you email us at [email protected] or any other SCENE IN THE DARK address: the contents of your message and your email address.
  • Newsletter or drop-list signups, if applicable: your email address.

b) Information collected automatically

  • Technical data: IP address, browser type and version, device type, operating system, referring URL, pages visited, and timestamps.
  • Cookies and similar technologies: small data files stored on your device for session management, cart state, and basic analytics. See Section 5.

c) Information from third-party payment processors

When you pay for a print, payment is processed by Stripe Payments Canada, Ltd. (“Stripe”). We do not see or store your full credit-card number, CVC, or bank account details. Stripe provides us only with limited transaction data: the last 4 digits of your card, the card brand, the billing country, and your name and email as entered on the checkout page.

2. How we use your information

We use personal information to:

  • process your print order and arrange shipping;
  • send order confirmations, shipping notifications, and authenticity certificates;
  • respond to your inquiries and provide customer support;
  • detect and prevent fraud, including verifying that the cardholder authorized the transaction;
  • maintain and improve the Site, including diagnosing technical issues;
  • comply with our legal obligations, including tax and consumer-protection law; and
  • with your consent, send occasional emails about new collections or drops. You can unsubscribe at any time using the link in any such email.

3. Who we share information with

We do not sell your personal information. We share it only with the following service providers, and only as needed to operate the Site and fulfill orders:

  • Stripe - payment processing. Stripe's privacy policy is available at stripe.com/privacy.
  • Supabase (Supabase, Inc.) - database and file storage, hosted on Amazon Web Services in the United States. Order and customer records are stored here.
  • Cloudflare (Cloudflare, Inc.) - hosting, content delivery, and email forwarding for sceneinthedark.com.
  • Shipping carriers (e.g. Canada Post, UPS, USPS, FedEx, DHL) - we share recipient name and shipping address with the carrier you select or that we select for your destination.
  • Email service providers - transactional emails (order and shipping confirmations) may be sent through a third-party provider such as Resend. These providers process your email address solely to deliver the message.
  • Professional advisors and authorities - we may disclose information to our accountant, lawyer, or government authorities where required by law (for example, in response to a subpoena or to comply with tax reporting).

We require each service provider to handle your information consistent with this Policy and applicable law.

4. International data transfers

Some of our service providers (including Supabase, Stripe, and Cloudflare) store or process information outside of Canada, including in the United States. By using the Site, you acknowledge that your information may be transferred to and processed in jurisdictions whose privacy laws may differ from those of your home country.

5. Cookies and analytics

We use a small number of strictly necessary cookies (for the shopping cart and session) and may use privacy-respecting analytics to understand aggregate Site usage. We do not use cross-site advertising trackers. You can disable cookies in your browser settings, but parts of the Site, including the cart and checkout, may not function properly.

6. How long we keep your information

We keep order records for as long as required by Canadian tax law (currently six years from the end of the tax year). We keep email correspondence for as long as reasonably needed to provide ongoing support, and newsletter signups until you unsubscribe.

7. Your rights

Under the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and equivalent provincial laws, you have the right to:

  • access the personal information we hold about you;
  • request correction of inaccurate or incomplete information;
  • withdraw your consent to our use of your information (which may mean we can no longer fulfill your order);
  • request deletion, subject to our legal record-keeping obligations; and
  • file a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca.

To exercise any of these rights, email us at [email protected]. We may need to verify your identity before fulfilling the request.

8. Children

The Site is not intended for children under 16, and we do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

9. Security

We use industry-standard safeguards to protect personal information, including HTTPS transport encryption, encrypted database storage, and access controls. However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security, and you use the Site at your own risk.

10. Changes to this Policy

We may update this Policy from time to time. We will post the updated version on this page and revise the “Last updated” date above. Material changes will be communicated to active customers by email where reasonably possible.
